Terms of Service

These terms are an agreement between you and Automatos Solutions LLC ("we", "us"), which runs Evo. By creating an account or using Evo, you agree to them. If you don't agree, don't use Evo. Our Privacy Policy explains how we handle your information.

Your account

You need an account to use Evo. You must be at least 13 years old and, if you're under 18, have a parent's or guardian's permission. Keep your sign-in secure; you're responsible for what happens under your account. Tell us at support@use-evo.com if you think someone else has used it.

Plans and payment

Subscriptions. Evo is paid by monthly subscription. Each plan includes a monthly usage allowance, shown on our pricing page and in Settings. When you've used a month's allowance, some features pause until your plan renews.

Billing. Your subscription renews automatically every month on the date you subscribed, and we charge the card you gave us through Stripe until you cancel. Prices are in US dollars and don't include taxes; any sales tax or VAT that applies where you live is added at checkout and shown before you pay. We'll tell you in advance before changing the price of your plan; the new price applies from your next renewal after that notice.

Changing plan. Moving to a larger plan takes effect immediately, and you pay the difference for the rest of the current month. Moving to a smaller plan takes effect at your next renewal.

Cancelling. You can cancel at any time from Settings. Your plan stays active until the end of the month you've paid for, and you won't be charged again.

Refunds. Payments are non-refundable, including for partly used months, except where the law requires a refund. If something went wrong, contact us at support@use-evo.com and we'll look at it.

Failed payments. If a payment fails, access to paid features pauses until the payment goes through. If it can't be collected after several attempts, your subscription is cancelled.

Your content

"Your content" is what you put into Evo: your messages, plans, materials and any chat histories you import. You keep ownership of it. You give us permission to store, process and transmit it (including sending it to the AI providers described in our Privacy Policy) as needed to run Evo for you, and to use it, once information that identifies you has been removed, to test and improve Evo.

You're responsible for your content, and you promise that you have the right to use it in Evo. In particular, only import chat exports from your own accounts.

What Evo generates for you (plans, lessons, replies) is yours to use. We don't claim ownership of it.

Acceptable use

Don't use Evo to:

  • break the law or infringe anyone's rights;
  • create content that is harmful, harassing, sexually exploits anyone, or promotes violence;
  • try to get around plan limits, access other people's accounts or data, or interfere with Evo's servers (for example, overloading them or probing for weaknesses);
  • resell Evo or access it by automated means, except as we allow;
  • copy Evo's software or use it to build a competing product.

We may suspend or close accounts that break these rules.

AI-generated content

Evo's plans, lessons and replies are generated by AI. They can be wrong, incomplete or out of date. Evo is a learning aid: don't rely on it for medical, legal, financial or other professional advice, and check anything important against trusted sources.

Evo itself

Evo's software, design and branding belong to us. These terms don't give you any right to them beyond using Evo as intended. If you send us feedback or ideas, we may use them without owing you anything.

We're continually improving Evo, so features may change, and we may add or remove some. If we ever stop offering Evo altogether, we'll give you reasonable notice and refund any unused prepaid period.

Ending your account

You can delete your account at any time from the account menu; this cancels your subscription and deletes your data as described in our Privacy Policy. We may suspend or close your account if you break these terms or if we have to by law. Sections that by their nature should continue (such as "Disclaimers" and "Limitation of liability") continue after your account ends.

Disclaimers

Evo is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that Evo will be uninterrupted, error-free or fit for a particular purpose, or that its AI-generated content is accurate.

Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data, profits or opportunities. Our total liability for any claim relating to Evo is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

Changes to these terms

We may update these terms. We'll change the date at the top, and if a change is significant we'll tell you by email or in Evo before it takes effect. If you keep using Evo after a change takes effect, you accept the new terms.

Governing law

These terms are governed by the laws of the State of Florida, United States, and disputes will be handled in the state or federal courts located in Florida, except where the law of your country gives you the right to bring claims where you live.
